Estafa is against the law therefore those caught doing this cannot escape the law. The penalty could be life imprisonment to death in my country. I do not know about your country's verdict for a criminal doing estafa. If a person swindles, it is assumed that he is creating this illegal act being a member of a syndicate consisting of five or more persons. To take action, the first party, the victim must provide prima facie evidence to establish the case of fraudulent act. This includes false statements, falsifying documents, or using other deceptive means to induce the victim into a transaction or action.
 
No matter the reason for them to carry out such action, it is wrong. I have seen some persons who are into this give sad stories as to why they did it but a crime would always be a crime.
 
I wonder why they are not afraid of the law. What is on their mind is money. They never care about the feelings of the victim. But once they are caught, they will land in jail. The family will be involved and may act as an accomplice.
